According to the lastest report released by the NHS Litigation Authority (NHSLA), allegations of failure to adequately warn patients of the risks associated with certain treatments and procedures continue to form a part of many nhs negligence claims.
In the report published in June 2011, the NHSLA state that in the five years between April 2006 and March 2011, more than 1,000 claims contained an allegation relating to consent. At the time of the report in June 2011, a third of those claim closed with a total of over £25million being paid in damages and costs to people who have had to sue the NHS.
The report has suggested that consent training be improved.
